West Bend Insurance Company, its affiliates, and its subsidiary providers of property and casualty insurance (“West Bend,” “we,” “our,” or “us”), understands how important your privacy is and wants you to understand how we use your information. This Online Privacy Policy (“Policy”) applies to any information collected, used, and disclosed by West Bend offline and through our website, thesilverlining.com, our West Bend mobile application, and any other website or application we may post this Policy to or that links to this Policy (collectively the “Site”). This Policy will let you know what kind of information we collect on our Site and offline, how we collect that information, and what we do with it. If this Policy or the corresponding Terms of Use are not consistent with your values or are not acceptable to you, we kindly ask that you do not use the Site. While this Policy describes how we treat personal information, please be aware that additional terms and conditions may apply for certain parts of our Site.

This Policy does not replace other applicable policies, practices, and privacy notices that may relate to specific business relationships you have with West Bend, including our Privacy Statement. Depending on your relationship with us, one or more of our privacy documents may apply to you, in addition to this Policy. Our Privacy Statement governs how we collect, use, and disclose personal information related to our insurance products. In the event of a conflict between this Policy and our Privacy Statement, if applicable, the Privacy Statement shall govern.

CATEGORIES OF INFORMATION WE COLLECT

We may collect personal information about you when contact us or use the Site. In the past twelve (12) months, we have collected the following categories of personal information:

INFORMATION WE OBTAIN FROM THIRD PARTIES

From time to time, we receive information about individuals from our third party service providers, affiliates, agents, social media services, and partners. For example, we may receive information through email campaigns with our third party service providers, including whether you have read an email sent by us or on our behalf, forwarded an email, and when and how many times you have opened an email. We may also receive information from third party analytics on the Site that allow us to improve our Site and services. If you apply for employment with West Bend, your employment application information will be collected by our third-party service provider and shared with West Bend.

SALE AND SHARING OF PERSONAL INFORMATION

  • Right to Request Deletion: The right to request that West Bend delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  • The Right to Correct: The right to correct inaccurate personal information that we maintain about you.
  • The Right to Opt-Out of the Targeted Advertising and the Sale or Sharing of Your Personal Information: The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising.
  • The Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising these rights.
  • “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party's direct marketing purposes.
  • Marketing Opt-Out. You may opt-out of receiving future marketing communications from us by using the unsubscribe link at the bottom of email communications from us. We will use commercially reasonable efforts to process such request in a timely manner.

EXERCISING YOUR RIGHTS

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must:

  • Provide sufficient information that allows West Bend to reasonably verify you are the person about whom it collected personal information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. To verify your identity, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. If you do not agree with how we responded to your request, you may ask us to review our decision by contacting us through the above noted methods.

RESPONSE TIMING AND FORMAT

West Bend endeavors to respond to a verifiable consumer request within 45 days of its receipt. If West Bend requires more time (up to 90 days), it will inform you of the reason and extension period in writing. West Bend will deliver the written response by mail or electronically, at your option. The response West Bend provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, West Bend will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

RETENTION OF INFORMATION

West Bend will retain your personal information only for as long as is necessary for the purposes set out in this Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

EXTERNAL WEBSITES

Our Site may contain links to websites operated and maintained by third parties, including social media platforms. We have no control over and are not responsible for the privacy policies or content on those websites. Links to third party websites do not imply an affiliation between West Bend and the website owner, or any endorsement, approval, or verification of any content contained on those websites. Privacy policies on third-party websites may be different from our Policy. You access such links at your own risk. We recommend you read the privacy policy of a website before disclosing any of your information.

CHILDREN UNDER THE AGE OF 13

We do not knowingly collect personal information from children under 13 through our Site. In the event that we learn that we have collected personal information from a child under the age of 13 without parental consent, we will delete that information and otherwise comply with the requirements of any applicable law, including the Children’s Online Privacy Protection Act.
